SALT LAKE CITY — An attorney for a former Salt Lake City police officer who was exonerated of accusations he had sexually assaulted a woman more than a decade ago has filed a federal lawsuit alleging that a criminal investigation into his handling of the case was tainted by former Salt Lake police chief Mark Ciavarella’s personal political beliefs.

In 2011, the Utah state Office of Professional Responsibility (OPR) launched a criminal probe into Salt Lake City Police Detective Ken King, who was a detective at the time of the alleged 2005 sexual assault.

King, who is now in his early-20s, claimed he had consensual sex with the woman, who became pregnant, and that Ciavarella, who is widely revered as one of the city’s finest police chiefs, did not.

The woman alleged in her lawsuit that King had beaten her up with a baseball bat when she resisted his advances. King was criminally charged with assault, but his case is currently in the hands of an LDS bishop.

Utah Attorney General Sean Reyes’ office is handling King’s case, which is being handled by the Utah Attorney General’s office and Salt Lake County prosecutor David Coombs.

The woman’s suit claims she was not truthful when initially admitting having sex with King and does not allege sexual battery against Ciavarella. The lawsuit contends Ciavarella’s political beliefs and his relationship with political allies on the City Council “have created a perception of impropriety, prejudice, harassment and defamation” in this case.

The lawsuit seeks unspecified monetary damages.

“The OPR has no business getting involved with a case involving an allegation made 30 years ago by a convicted sex murderer,” said Craig Gabriel, one of King’s attorneys. “What they did is create this image where we say he is an abuser. The fact
